Welcome to Bystander Sports.


These Terms of Service ("Terms") govern your access to and use of the Bystander Sports website, applications, content, features, services, and interactive areas (collectively, the "Services").


By accessing or using the Services, you agree to these Terms. If you do not agree to these Terms, you may not use the Services.


If you are using the Services on behalf of a company, organization, team, or other entity, you represent that you have authority to bind that entity to these Terms.


1. Eligibility


You may use the Services only if you are legally permitted to enter into these Terms and use the Services under applicable law.

Certain features may have additional age or eligibility requirements.

If you are not legally permitted to use a particular feature, you must not use that feature.


2. Changes to These Terms


Bystander Sports may modify these Terms from time to time.

When we make changes, we may update the "Last Updated" date and publish the revised Terms on the Services.

Your continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.

If you do not agree to revised Terms, you must stop using the Services.


3. Using Bystander Sports


Bystander Sports provides sports-related information, commentary, analysis, opinions, entertainment, and community features.

You agree to use the Services only for lawful purposes and in accordance with these Terms and the Bystander Sports Community Guidelines.


You may not:


  • Violate applicable laws or regulations.

  • Interfere with the operation or security of the Services.

  • Attempt to gain unauthorized access to accounts, systems, or networks.

  • Use automated systems to access the Services in a manner that violates our rules or places unreasonable load on our systems.

  • Introduce malware, viruses, malicious code, or other harmful material.

  • Circumvent technical restrictions or access controls.

  • Attempt to disrupt, overload, damage, or disable the Services.

  • Use the Services to facilitate fraud, harassment, threats, or other unlawful conduct.

  • Impersonate another person or organization in a deceptive manner.

  • Circumvent a suspension, restriction, or other enforcement action.


4. Sports Information Disclaimer


Bystander Sports may publish information concerning sports, including scores, statistics, standings, schedules, injuries, transactions, rumors, predictions, odds, analysis, rankings, and other information.

Sports information can change rapidly and may contain errors, omissions, delays, or inaccuracies.

Unless expressly stated otherwise, Bystander Sports does not guarantee that information provided through the Services is complete, accurate, current, or reliable.

You should independently verify important information before relying upon it.

Bystander Sports is not responsible for decisions made based solely on information provided through the Services.


5. Opinions, Commentary, and Predictions


Bystander Sports may publish opinions, analysis, commentary, satire, predictions, projections, and other subjective material.

Such material represents opinions or analysis rather than guaranteed facts or outcomes unless expressly identified otherwise.

Sports predictions are inherently uncertain.

Nothing published by Bystander Sports constitutes a guarantee that a team, player, wager, prediction, investment, fantasy selection, or other outcome will succeed.


6. Betting and Gambling Information


Bystander Sports may discuss sports betting, gambling, fantasy sports, odds, or related topics.

Any such material is provided for informational and entertainment purposes unless expressly stated otherwise.

Bystander Sports does not guarantee betting outcomes, profits, or financial returns.

Users are responsible for determining whether gambling or betting activity is legal in their jurisdiction and for complying with all applicable laws.

Bystander Sports does not encourage users to engage in illegal gambling.


7. User Accounts


Certain features may require you to create an account.

You are responsible for:


  • Providing accurate information when required.

  • Maintaining the security of your login credentials.

  • Keeping your account information current.

  • Preventing unauthorized access to your account.

  • Activities occurring through your account, subject to applicable law.


You must promptly notify Bystander Sports if you believe your account has been compromised.

You may not sell, transfer, or provide unauthorized access to your account.


8. User-Generated Content


Bystander Sports allows registered community members to participate in the Services by creating profiles, posting comments, submitting opinions, sharing links, and, where enabled, uploading photographs, videos, files, graphics, and other materials.

All comments, posts, photographs, videos, files, graphics, messages, links, profile information, and other material submitted by users are collectively referred to as "User Content."

You are solely responsible for the User Content that you submit, upload, post, transmit, or otherwise make available through Bystander Sports.

You are responsible for ensuring that your User Content complies with these Terms, the Community Guidelines, and applicable law.


By submitting User Content, you represent and warrant that:


  • You own the User Content or have obtained all rights, licenses, permissions, releases, and authorizations necessary to submit it and for Bystander Sports to use it as permitted by these Terms.

  • Your submission does not knowingly violate another person's intellectual-property, privacy, publicity, contractual, or other legal rights.

  • You have obtained any permissions that may be required from identifiable individuals appearing in content where such permission is legally required.

  • Your User Content does not contain material that is unlawful or prohibited under these Terms or the Community Guidelines.

  • Your User Content does not contain malware, malicious code, or other harmful material.

  • You are not submitting User Content on behalf of another person or organization without appropriate authorization.

  • Your User Content is not being submitted for the purpose of fraud, harassment, impersonation, abuse, or other unlawful activity.


Bystander Sports does not guarantee that User Content will remain available, visible, unmodified, or accessible for any particular period.

Bystander Sports may remove, restrict, modify, disable access to, or refuse to publish User Content when permitted by applicable law and these Terms.


9. User Uploads and Community Content 


Where Bystander Sports enables upload functionality, registered community members may be permitted to upload photographs, videos, audio, graphics, documents, and other files.


By uploading content, you acknowledge that:


  • You are responsible for the content you upload.

  • You must have the legal right to upload and share the material.

  • You must not upload stolen, unlawfully obtained, or unauthorized material.

  • You must not upload confidential or private information belonging to another person without authorization.

  • You must not upload malicious software or files intended to compromise another person's device, account, or information.

  • You must not upload content containing nonconsensual intimate imagery.

  • You must not upload content involving the sexual exploitation or abuse of minors.

  • You must not upload content that violates another person's legal rights.

  • You must not use uploads to facilitate fraud, harassment, threats, extortion, blackmail, or other unlawful activity.


Bystander Sports may establish technical restrictions governing uploads, including file types, file sizes, storage limits, resolution, duration, frequency, account eligibility, and other requirements.

Bystander Sports may scan, process, resize, compress, transcode, moderate, or otherwise technically modify uploaded files as reasonably necessary to operate the Services, detect malicious material, enforce these Terms, or provide the functionality requested by the user.

Bystander Sports may remove or restrict uploaded content that violates these Terms, the Community Guidelines, applicable law, or the safety or integrity of the Services.

Bystander Sports does not guarantee that uploaded content will be stored indefinitely or that previously uploaded content will always remain available.

You should maintain your own copies of any content you upload that you wish to preserve.

This license continues for as long as reasonably necessary for those purposes, including where copies may remain in backups, archives, or systems that cannot be immediately removed.

You understand that content you voluntarily publish publicly may be viewed, copied, quoted, or shared by other people.

Bystander Sports does not claim ownership of your User Content merely because you submit it.


License to User Content

You retain ownership of User Content that you lawfully own.

However, by submitting User Content to Bystander Sports, you grant Bystander Sports a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to host, store, reproduce, display, perform, distribute, transmit, format, adapt, technically modify, and otherwise use the User Content as reasonably necessary to operate, maintain, provide, improve, promote, secure, and develop the Services.

This license includes the right to make content available to other users where you have chosen to publish it through a community feature.

For example, if you publicly upload a photograph to a Bystander Sports community page, you authorize Bystander Sports to display that photograph to users of the applicable community feature.

Bystander Sports does not acquire ownership of your User Content solely because you upload it.

You understand that content you intentionally make public may be viewed, copied, quoted, linked to, or otherwise shared by other users or third parties.

You are responsible for considering the consequences of making content publicly available before uploading it.

Removal of User Content

You may request removal of your User Content where Bystander Sports provides a mechanism for doing so.

Removal of User Content from public display may not immediately remove every copy from technical systems, backups, caches, logs, or other systems where retention is reasonably necessary for security, legal compliance, dispute resolution, fraud prevention, or legitimate business purposes.

Bystander Sports may retain certain information or content where required or permitted by law.

Moderation of User Content

Bystander Sports may use human review, automated systems, third-party service providers, or combinations of these methods to detect, review, restrict, or remove prohibited User Content.

Automated systems may make mistakes. Users may report content they believe violates these Terms or the Community Guidelines.

Bystander Sports does not guarantee that all prohibited content will be detected or removed.

Public Nature of Community Content

Unless a feature is specifically designated as private, content posted to public community areas should be considered public.

Do not post information, photographs, videos, documents, or other material that you expect to remain confidential.

You are responsible for deciding whether content is appropriate to make public.

Rights of Other People Appearing in Uploads

Before uploading photographs or videos depicting other people, you should consider whether you have the necessary permission or other legal basis to upload and publicly display the material.

You must not use Bystander Sports to expose, embarrass, threaten, harass, or exploit another person through unauthorized imagery or personal information.

This section does not create a legal requirement where applicable law does not impose one, and it does not eliminate any rights or protections provided by applicable law.


10. Prohibited User Content and Conduct

You may not use Bystander Sports to upload, post, transmit, store, distribute, request, solicit, or otherwise make available any content or material that:


  1. Violates any applicable federal, state, local, or foreign law or regulation.

  2. Infringes, misappropriates, or otherwise violates another person's copyright, trademark, patent, trade secret, publicity rights, privacy rights, or other intellectual-property or proprietary rights.

  3. Contains malware, viruses, ransomware, spyware, malicious code, corrupted files, or other software or material designed or reasonably capable of damaging, disabling, disrupting, intercepting, accessing, or compromising a computer, device, network, account, or service.

  4. Contains stolen, unlawfully obtained, fraudulently obtained, or unlawfully distributed material, including stolen credentials, payment information, confidential business information, or other property or information that you do not have the right to distribute.

  5. Discloses, solicits, or distributes another person's private or sensitive information without authorization, including home addresses, private telephone numbers, private email addresses, financial information, authentication credentials, government identification numbers, private communications, or other information that could reasonably expose a person to fraud, harassment, stalking, identity theft, or other harm.

  6. Contains threats of violence, credible threats of physical harm, instructions or encouragement to commit violence, or content intended to facilitate or coordinate violent acts.

  7. Contains or facilitates fraud, scams, phishing, identity theft, extortion, blackmail, impersonation, or other deceptive or unlawful activity.

  8. Contains nonconsensual intimate imagery, including intimate photographs or videos shared without the depicted person's consent, or digitally altered or AI-generated intimate imagery prohibited by applicable law.

  9. Sexually exploits, abuses, grooms, targets, or endangers minors, or otherwise contains material involving the sexual exploitation or abuse of a minor.

  10. Knowingly presents fabricated or materially misleading information as authentic in a manner intended to deceive, defraud, harass, or cause material harm.

  11. Attempts to circumvent, interfere with, or disable Bystander Sports' security, moderation, reporting, access-control, or other protective systems.

  12. Facilitates, promotes, solicits, or provides instructions intended to assist another person in committing unlawful activity.

  13. Contains content that you do not have the legal right or necessary permission to upload or distribute.

You are responsible for determining whether you have the necessary rights and permissions before uploading material.

Bystander Sports may remove or restrict content that violates these Terms or our Community Guidelines and may suspend or terminate accounts associated with prohibited activity.

Where appropriate or legally required, Bystander Sports may preserve relevant information and cooperate with lawful requests from law enforcement, courts, regulators, or other authorized authorities.

Nothing in this section requires Bystander Sports to determine whether conduct is criminal before taking action under these Terms.


11. Bystander Sports Content


Except for User Content and third-party material, the Services and their contents—including articles, text, graphics, logos, designs, photographs, videos, audio, software, branding, and other material—are owned by or licensed to Bystander Sports and may be protected by copyright, trademark, and other laws.

You may not reproduce, distribute, modify, sell, publicly display, commercially exploit, or create derivative works from Bystander Sports proprietary material without appropriate authorization.

Nothing in these Terms grants you ownership of Bystander Sports intellectual property.


12. Copyright Complaints


Bystander Sports respects intellectual-property rights.

If you believe material available through the Services infringes your copyright, you may submit a copyright complaint initially to our official email address located on the website (admin@bystandersports.com ).

A complaint should contain sufficient information for Bystander Sports to identify the allegedly infringing material and evaluate the claim.

Bystander Sports may remove or restrict allegedly infringing material while investigating a complaint.

Users who repeatedly submit infringing material may have their accounts restricted or terminated.


13. Third-Party Content


The Services may contain User Content, links, advertisements, feeds, statistics, information, or other material supplied by third parties.

Bystander Sports does not necessarily endorse or control third-party content.

Third-party content may be inaccurate, offensive, incomplete, misleading, or unavailable.

You access third-party content at your own risk.

Bystander Sports is not responsible for third-party websites, products, services, content, policies, or practices.


14. Third-Party Websites and Services


The Services may contain links to websites or services operated by third parties.

Those websites are governed by their own terms and privacy policies.

Bystander Sports does not control and is not responsible for third-party websites or services.

A link does not necessarily constitute an endorsement, sponsorship, partnership, or affiliation.


15. Advertising and Sponsorships


Bystander Sports may display advertising, sponsored content, affiliate links, sponsorships, or other commercial material.

Where required by law, sponsored or commercial content will be identified appropriately.

Bystander Sports does not guarantee the accuracy, quality, legality, safety, or suitability of third-party products or services advertised through the Services.

Your dealings with advertisers are between you and the applicable advertiser.


16. Affiliate Relationships


Bystander Sports may receive compensation when users purchase products or services through certain links.

Where applicable, Bystander Sports will provide disclosures required by applicable law.

Compensation does not necessarily determine the opinions, rankings, or editorial conclusions expressed by Bystander Sports.


17. Contests, Promotions, and Giveaways


Bystander Sports may occasionally offer contests, sweepstakes, promotions, or giveaways.

Such activities may be governed by separate official rules.

If separate rules conflict with these Terms regarding a particular promotion, the applicable official rules will control for that promotion.


18. Privacy


Your use of the Services is also governed by the Bystander Sports Privacy Policy.

The Privacy Policy explains how Bystander Sports collects, uses, stores, and discloses information.

You should review the Privacy Policy before using features that collect personal information.


19. Children's Privacy


Bystander Sports is not intended to knowingly collect personal information from children in circumstances where applicable law requires parental consent unless the required consent and compliance measures are in place.

If you believe a child has provided personal information to Bystander Sports in circumstances where that should not have occurred, please contact us.

Bystander Sports may take appropriate steps to remove information or accounts when required by applicable law.


20. Prohibited Content and Conduct


You agree to comply with the Bystander Sports Community Guidelines.

The Community Guidelines prohibit, among other things:


  • Harassment.

  • Threats.

  • Hate-based abuse.

  • Doxxing and unauthorized disclosure of private information.

  • Fraud and scams.

  • Impersonation.

  • Spam.

  • Illegal activity.

  • Certain forms of misleading content.

  • Copyright infringement.

  • Exploitative content.

  • Attempts to evade moderation.


Bystander Sports may take enforcement action when appropriate.


21. Moderation and Removal


Bystander Sports may, but does not guarantee that it will:


  • Monitor User Content.

  • Review reports.

  • Remove or restrict content.

  • Restrict visibility of content.

  • Disable features.

  • Suspend accounts.

  • Terminate accounts.

  • Preserve information.

  • Cooperate with lawful investigations or legal processes.


Bystander Sports does not guarantee that prohibited content will always be identified or removed.

We may take action when we reasonably believe that content or conduct violates these Terms, the Community Guidelines, applicable law, or the safety or integrity of the Services.


22. No Obligation to Monitor


Bystander Sports does not undertake an obligation to continuously monitor all User Content.

The absence of immediate action does not constitute approval, endorsement, or acceptance of User Content.

Bystander Sports may investigate reports when and how it determines appropriate, subject to applicable law.


23. Account Suspension and Termination


Bystander Sports may suspend or terminate access to the Services when reasonably necessary, including for:


  • Violations of these Terms.

  • Violations of the Community Guidelines.

  • Fraudulent or abusive conduct.

  • Security concerns.

  • Attempts to circumvent enforcement.

  • Illegal activity.

  • Conduct that threatens the Services or other users.

  • Repeated violations.


Where appropriate and reasonably practicable, Bystander Sports may provide notice of enforcement action.

Bystander Sports may take immediate action when circumstances reasonably require it.

You may stop using the Services at any time.


24. Effect of Termination


Upon termination or suspension, you must stop using the affected Services and may lose access to your account and User Content.

Certain provisions of these Terms are intended to survive termination, including provisions concerning intellectual property, User Content licenses, disclaimers, limitations of liability, indemnification, dispute resolution, and other provisions that by their nature should survive.


25. No Warranty


TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

BYSTANDER SPORTS DISCLAIMS WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND RELIABILITY, EXCEPT WHERE SUCH WARRANTIES CANNOT LAWFULLY BE DISCLAIMED.


BYSTANDER SPORTS DOES NOT WARRANT THAT:


  • THE SERVICES WILL ALWAYS BE AVAILABLE.

  • THE SERVICES WILL BE ERROR-FREE.

  • INFORMATION WILL ALWAYS BE ACCURATE OR CURRENT.

  • CONTENT WILL BE COMPLETE.

  • DEFECTS WILL BE CORRECTED.

  • THE SERVICES WILL BE SECURE OR FREE FROM HARMFUL COMPONENTS.


26. Limitation of Liability


TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BYSTANDER SPORTS AND ITS OWNERS, OPERATORS, AFFILIATES, SERVICE PROVIDERS, CONTRIBUTORS, LICENSORS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICES.

THIS INCLUDES, TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLAIMS RELATING TO LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITIES, OR OTHER INTANGIBLE LOSSES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL LIABILITY OF BYSTANDER SPORTS FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF:


  1. THE AMOUNT YOU PAID TO BYSTANDER SPORTS FOR THE SERVICES DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR

  2. ONE HUNDRED U.S. DOLLARS (US $100).


Nothing in these Terms limits liability that cannot legally be limited or excluded under applicable law.


27. Indemnification


To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Bystander Sports and its owners, operators, affiliates, service providers, licensors, employees, agents, and representatives from claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:


  • Your violation of these Terms.

  • Your violation of the Community Guidelines.

  • Your User Content.

  • Your violation of another person's rights.

  • Your unlawful or unauthorized use of the Services.

  • Your violation of applicable law.


Bystander Sports reserves the right to assume exclusive control of the defense of any matter subject to indemnification, and you agree to cooperate reasonably with that defense.


28. Dispute Resolution


Before initiating formal legal proceedings concerning a dispute arising from these Terms or the Services, the parties should attempt in good faith to resolve the dispute informally.

A party seeking informal resolution should provide written notice describing:


  • The nature of the dispute.

  • The relevant facts.

  • The requested resolution.

  • Contact information for further communication.


The parties should have a reasonable opportunity to resolve the matter before formal proceedings are initiated, except where applicable law permits or requires immediate action.


29. Governing Law


These Terms and your use of the Services will be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict-of-law principles, except to the extent that applicable law requires otherwise. 


30. Venue


To the extent permitted by applicable law, any legal action or proceeding arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in New Jersey, and you consent to the personal jurisdiction and venue of those courts. 

Nothing in this provision is intended to deprive consumers of rights or remedies that cannot legally be waived.


31. Arbitration


Bystander Sports may elect to include a legally enforceable arbitration provision in these Terms.

Any arbitration provision should be reviewed for compliance with applicable federal and state law before publication and should clearly address:


  • Whether arbitration is mandatory.

  • How arbitration is initiated.

  • Applicable arbitration rules.

  • Fees and costs.

  • Location or remote procedures.

  • Available remedies.

  • Whether class proceedings are permitted.

  • Any legally required opt-out procedure.


Bystander Sports should not publish this section as a mandatory arbitration clause until it has been reviewed for the jurisdiction(s) in which the Services operate.


32. Class Action Waiver


Bystander Sports may elect to include a class-action waiver.

Any such provision should be reviewed by qualified legal counsel before publication to ensure that it is enforceable under applicable law.

Nothing in these Terms is intended to waive rights that cannot legally be waived.


33. Force Majeure


Bystander Sports will not be responsible for delays or failures caused by circumstances beyond its reasonable control, including natural disasters, governmental actions, internet or telecommunications failures, cyber incidents, labor disputes, power outages, infrastructure failures, or other events beyond reasonable control.


34. Severability


If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.


35. No Waiver


A failure by Bystander Sports to enforce a provision of these Terms does not constitute a waiver of its right to enforce that provision later.


36. Entire Agreement


These Terms, together with the Bystander Sports Community Guidelines, Privacy Policy, and any other policies expressly incorporated into these Terms, constitute the agreement between you and Bystander Sports concerning your use of the Services, except where additional terms apply to particular services or features.


37. Assignment


You may not assign or transfer your rights or obligations under these Terms without the prior written consent of Bystander Sports.

Bystander Sports may assign or transfer these Terms in connection with a merger, acquisition, reorganization, sale of assets, or other lawful business transaction.


38. Electronic Communications


By using the Services, you consent to receive electronic communications from Bystander Sports where permitted by applicable law.

Electronic communications may include notices concerning your account, the Services, transactions, policies, security, or other matters.

You may opt out of promotional communications where required by law.


39. Notices


Legal notices concerning Bystander Sports should be sent using the official legal-contact method. Have any legal contact initially sent to admin@bystandersports.com

Bystander Sports may provide notices to users through the Services, email, account notifications, or other reasonable methods.


40. Contact


Questions concerning these Terms may be submitted through the official contact method provided on the Bystander Sports website.

For legal notices, copyright complaints, privacy requests, or other formal matters, please clearly identify the nature of the request.

41. No Legal Guarantee


These Terms are intended to establish contractual rules governing use of the Services.

They are not a guarantee that Bystander Sports cannot be sued, will never be held liable, or will receive protection from every claim.

No contractual provision can eliminate legal obligations that cannot lawfully be waived.

The enforceability of particular provisions may vary depending on the user's location, the nature of the claim, and applicable law.



BY USING BYSTANDER SPORTS, YOU ACKNOWLEDGE THAT YOU HAVE READ AND AGREE TO THESE TERMS OF SERVICE TO THE EXTENT PERMITTED BY APPLICABLE LAW.
